Yes, in an ideal world, the seller would not take any actions until ALL of the buyer's contingencies are fulfilled, not just his mortgage contingency.  Unfortunately, the reality is that people are pressed for time and have to make preparations early on.  Also, oftentimes the mortgage contingency is not satisfied until just days before closing!
